Your use of this web site is subject to the following terms and conditions, which by using the web site you are deemed to have accepted. Other purchases from IPM Division, including via telephone or in person at trade shows, etc, are subject to the following terms and conditions translated to purchases "offline" and by making a purchase are deemed to have accepted these Terms. Copies are available in person, by post, or on this web site.

Purchasing from IPM Division

Status of Terms
These terms constitute a legal document ("the Agreement"), which sets out the rights and obligations of you as a purchaser ("you"), and those of IPM ("IPM", "we" or "us"), in relation to the services and products offered by us through this site, via telephone, or in person at trade shows and events, or on any of the other sites owned by us. By registering for IPM services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services.

You agree to:
provide true, accurate, current and complete information about yourself as prompted by our registration form (such information being the "Registration Data"); and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or IPM has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, IPM has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the IPM site (or any portion of it).

Place of performance and applicable law
IPM is a company registered in England. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. IPM makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement.

You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement. If any provision of this Agreement shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Please note that if you are purchasing from IPM as an entity, or a business, for the purposes of your business, you are excluded from many of the protections of the Distance Selling Regulations and Sale of Goods Act. In any event if you are covered under those protections they will be strictly interpreted and the buyer will bear costs where there is an option.

Placing an order
If placing an order over the telephone or in person, the following will happen if necessary in "real time" and some pre-contract information and order acceptance will be verbal. A notice will be displayed on your web browser before you submit an order with IPM ("the Pre-contract Notice"). The Pre-contract Notice contains important information such as a description, price and delivery charges of the good or services ordered. IPM suggests that you print off a hard copy of the notice or save a copy to your hard drive for your own records.
IPM will not be obliged to supply the goods or services submitted in your order until you have received an e-mail from IPM accepting your order ("Order Confirmation"). However, in the event the goods or services are listed on IPM's site at an incorrect price due to typographical error or error in pricing information received from its suppliers but IPM have accepted your order before the discrepancy is noticed, IPM shall e-mail you to ask whether you are willing to pay the correct price for the goods or services ordered. If you are unwilling to pay the correct price IPM reserves the right to cancel the contract immediately without any liability to you.
If IPM exercises its right in accordance with these terms to cancel a contract, it will immediately issue a credit to your debit or credit card account if it has already made a charge to your card before cancelling your order.
In the event that the goods ordered by you are not available IPM reserves the right to provide you with goods of a similar quality and specification and will inform you of such following your placing the order as soon as practically possible.
If for any reason you are not completely satisfied with your table, chair or accessory, you may return it, at your cost, within 14 days of order for a full refund - excluding our 25% card processing fee (Returns must be approved and in like-new condition with all packaging and any free or included gifts. Our prices are fully inclusive of shipping (excludes NI and other select postcodes listed on our site where there is a small surcharge - please phone or email for a quotation).

Payment
Payment for all courses and couches, chairs, uniforms and accessories, are to be made prior to provision of goods or services by cheque or credit / debit card.

Right to cancel
You have the right to cancel any contract within seven days from the date IPM sent you the Order Confirmation if IPM has contracted to supply services to you, if IPM has not started to provide those services before the expiry of the cancellation period.

The cancellation notice should be sent via e-mail to IPM at [info@injuryprevention.org.uk] and must state your name, a description of the goods or services concerned and the contract number of the cancelled contract. If ordered online, attaching the Order Confirmation IPM originally sent you will also assist IPM in processing your cancellation as quickly as possible. [The contract number is stated in the Order Confirmation e-mailed to you on IPM's acceptance of your order if ordered online, or is the invoice number of the paid invoice sent to you following your order.]
Where IPM have supplied goods to you, you must take reasonable care of the goods in your possession pending their return to IPM. IPM will only accept the returned goods in their original packaging and which do not exhibit signs of wear or tear. Any use of the delivered goods beyond that necessary to inspect the goods on delivery will invalidate your right to cancel the contract.
You must return the goods to IPM by registered post or similar within five days (excluding Saturdays, Sundays or Bank Holidays) from the date of the Cancellation Notice. You are responsible for the cost of returning the goods to IPM and the risk of damage to the goods in transit. If the goods are damaged in transit IPM reserves the right to refuse a refund and it will be your responsibility to seek compensation from the carrier.
Once IPM has received the returned goods and satisfied itself that you have complied with these Terms, it will send you confirmation by e-mail, or by telephone, or in writing that the return of the goods has been accepted by IPM and will immediately make a refund of the contract price minus 25% administration fee (5% card processing, 20% restocking) to your debit or credit card used to purchase the goods. Where we have been able to intercept the order prior to delivery to you, you will be refunded minus our 25% admin fee - there will be no charges for shipping. Cancelling a course less than 2 weeks before the first day of the course will subject you to non-refund of payment. If you cancel more than 2 weeks before the first day of the course, your payment may be refunded minus an admin fee of £25.00 + 3 % of the total amount paid.

Terms Specifically Relating to Levels 1 and 2 Training
You must be a qualified practitioner of massage, aromatherapy, or other form of bodywork approved in advance through the office. Although the Level 1 training is an advanced massage course, it is not a standalone massage qualification and does not serve as a replacement/substitute for the said standalone qualification.
At times, situations may arise that are completely out of IPM’s control and it may be necessary to reschedule the course. In this instance, if an alternative date can be arranged, you will only be entitled to a refund as per above.
You understand that this approach is potentially harmful to your clients and you and you agree not to teach them to others unless registered as a trainer with IPM.
It is your responsibility to look after your own body whilst learning and practising these techniques and the trainers accept no liability for any injury that you sustain either during or after this training.
You should be in good health and able to attend the course, and will forward, before the start of the course, details of any condition that should be brought to the attention of the trainer for consideration, as well as any related medication or medical treatment you are receiving. Successful certification on the course is on the basis of merit and the course trainer’s evaluation is final.
The course, although designed to a set format to accomplish a specific set of goals, may be modified by the trainer to fit the pace of the group.
No recording of any type will be permitted unless agreed prior to the event with IPM.
In the interests of safety, security, and comfort of the group as a whole, the trainer, or IPM, reserves the right to deny access to any individual – either from registration, or in the case of offensive behaviour in the group, to exclude that participant from the training event in its entirety or in part without prior notice or explanation, and without any refund.
IPM may reject any application for training on any grounds whatsoever.

Lifetime Warranty
Different manufacturers offer different warranties for their products. Lifetime warranties offered are valid for as long as you own your couch or for the life of the model, ending a period of two years after the model has been discontinued, whichever is shorter. Most offer a Limited Lifetime on the frame and subsequent 2-year warranty on the remainder of parts. Warranty claims are subject to approval by the manufacturer and are subject to shipping charges for pickup and re-delivery.

Limitation of Liability
Nothing in this Agreement shall affect the statutory rights of any consumer, exclude, or restrict any liability for death or personal injury arising from the negligence or fraud of IPM. Subject to clauses above, you agree that IPM shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any:
loss of profits, revenue or goodwill or any type of consequential, indirect or special loss or damage whatever arising from or in any way connected with this Agreement; direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not under IPM's direct control including, without limitation, damage for loss of business, loss of sales, non payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where IPM has been advised of the possibility of such loss or damage).

You also agree that (except in relation to such liability as has been expressly excluded in clauses above) the maximum aggregate of liability of IPM in contract, tort, negligence, statutory duty or otherwise (even where IPM has been advised of the possibility of such loss or damage), for any loss or damage whatever arising from or in any way connected with:

any defect in a product;
any failure by IPM to process signals, data, information, orders or messages correctly or in a timely manner;
any misrouting or non-delivery of signals, data information, messages or orders from you to other persons or from other persons to you, or any scrambling or distortion of data or information contained in them; and
any liability not excluded by this Agreement shall, in respect of any one or more events or series or events (whether connected or unconnected) taking place within any twelve month period be limited, in the case of defects falling within clauses above, to three times the price of the relevant goods/services. This limit shall also apply in the event that any exclusion or other provision contained in this Agreement is held to be invalid for any reason and IPM becomes liable for loss or damage that could otherwise have been limited.

You agree and acknowledge that you are in a better position than IPM to foresee and evaluate any potential damage or loss that you may suffer in connection with the goods and services provided by IPM, and therefore that IPM cannot adequately insure in respect of such liability. You warrant to IPM that you will insure against, or bear yourself, any loss for which IPM has excluded liability.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations of liability set out in this clause may not apply to you.

Indemnity
This website is for information purposes only. This information is not intended for use without professional advice. Save to the extent that it falls within the provisions of clauses above, you shall indemnify IPM and any third party (including its sub-contractors) from and against any liability, losses, rights, expenses, loss of profits, business interruption, consequential loss, pecuniary loss, claims or legal proceedings, including, but not limited to claims involving defamation and intellectual property infringement, and expenses, including legal fees, arising from your use of the IPM site or purchase of goods and/or services from that site which are brought or threatened against IPM or suffered or incurred by IPM by another person or entity.

Delivery
Delivery is included in the price for most Mainland UK addresses, but delivery is not included when ordering workwear/uniforms and needs to be added before checking out. Shipping to Ireland and the following postcodes have additional charges please email for exact cost: HS, IV, KA27-KA28, KW, PA20-PA49, PA60-PA78, PH17-PH26, PH30-PH44, PH49-PH50, ZE, BT, TR21-TR25, GY, AND JE. Delivery is usually 5 - 7 working days, but please allow up to 28 days for delivery (in the instance of out of stock items); Please contact us on 0845 0171117 for your specific delivery requirements as in-stock items can be shipped next-day. Delivery times quoted are estimates only, and IPM shall not be liable for any delays caused except to the extent caused wilfully or negligently by IPM. However, unless we have agreed a longer period for delivery with you, we will endeavour to either deliver goods and/or services within 28 days of you placing the order or we will endeavour to let you know as soon as it will not be possible to meet this obligation. If we do let you know then we will either agree a new time for delivery with you or, at your request, refund any monies paid by you in respect of the delayed goods/services in respect of the "Placing an Order" and "Right to Cancel" sections above.

Typographical and Pricing Errors
In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.

Matters Beyond our Reasonable Control
IPM shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.

Language
In the event of conflict or inconsistency between the terms of the English language version of this Agreement and any translation provided by us, the English language version shall prevail.

Severability
In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.

This Agreement
This Agreement, together with our Privacy Policy, contains the entire agreement and understanding between the parties relating to its subject matter, and (in relation to that subject matter) supersedes any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either party. Accordingly, we exclude all representations and warranties relating to the subject matter of this Agreement, whether they are statutory or otherwise, as far as is possible by law. In the event of conflict or inconsistency between the above documents, the following order of priority shall apply: (1) this Agreement (2) the Privacy Policy.

Liability
We endeavour to ensure that the information on this site is accurate and complete. However, the information is published 'as is' without any warranty. We do not accept any liability arising from any error, omission or inaccuracy of content or transmission. We cannot be held liable for any damages arising from the use of this site.

IPM may publish opinions and third party information and as such accept no liability whatsoever for any reliance placed on such opinions or information.

On this site you will be offered links to other sites. IPM does not accept any responsibility for these sites, the owners of which do not necessarily have any link, commercial or otherwise, with IPM. Specifically, we can have no liability for their content or privacy policies.
